Terms of Service

1. The Service

AvenueSnipe is a software platform that helps eBay sellers with product discovery and research, listing creation, pricing and repricing, automated monitoring, and supplier and product management.

The Service connects to third-party services, including eBay, and you are responsible for complying with the terms and policies of those services when using AvenueSnipe.

2. Eligibility and access

The Service is currently offered through invite-only early access. You may request access, but accounts are only created when we accept your request and send you an invitation.

You must be at least 18 years old and legally able to enter into a contract to use the Service. You are responsible for keeping your login credentials confidential.

3. Early access

Early access customers pay a monthly fee of $30/month (or such amount as published on the website) to use the current version of the platform.

During early access, features may change, be added, or be removed as we develop the platform. We will use reasonable efforts to communicate significant changes.

Early access is not a promise of any particular future feature, roadmap item, or pricing. Pricing for access after the early access period may differ.

4. Fees and payment

The Service is a paid subscription. There is no free trial and no free plan.

You agree to pay all fees associated with your subscription in advance. Payment is processed by a third-party payment provider.

We may change subscription fees by providing notice in advance. Continued use of the Service after a fee change constitutes acceptance of the new fees.

5. Acceptable use

You agree not to:

• Use the Service for any unlawful purpose or in violation of eBay’s or any third party’s terms and policies.
• Attempt to gain unauthorised access to the Service, other users’ accounts, or our systems.
• Use the Service to infringe any third party’s intellectual property or other rights.
• Resell, sublicense, or commercially exploit the Service or its output without our written permission.
• Introduce malicious software or interfere with the operation of the Service.

6. Your data

You retain ownership of the product, supplier, listing, and other data you import into the Service. You grant us a limited licence to process that data to provide the Service to you.

You are responsible for the accuracy and legality of the data you provide, and for ensuring you have the right to use it.

7. Intellectual property

AvenueSnipe, including its software, design, branding, and documentation, is owned by us or our licensors. You may not copy, modify, or create derivative works of the Service except as permitted by these Terms.

8. Third-party services

The Service relies on third-party services such as eBay, Amazon, and product suppliers. We are not responsible for the availability, accuracy, or conduct of third-party services or suppliers. Your use of those services is subject to their own terms.

9. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the Service will meet your business expectations, that results such as sales or profitability will be achieved, or that the Service will be uninterrupted or error-free.

10. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Service.

Our total liability to you for all claims arising out of these Terms will not exceed the total fees you paid to us in the three months preceding the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as for death or personal injury caused by negligence or fraud.

11. Termination

You may stop using the Service and cancel your subscription at any time.

We may suspend or terminate your access if you breach these Terms, if you use the Service unlawfully, or as required by law. On termination, your right to use the Service ends and we may delete your data after a reasonable period.

12. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and update the "Last updated" date. Where changes are material, we will use reasonable efforts to notify you by email. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
